1.1: This contract shall be deemed to have been signed between Fatih Çolak (referred to as Real Registry), which provides the services specified in the services section (referred to as Services) and the person / institution (referred to as Customer) specified in the details specified in the new customer registration section, with the use of the website (referred to as the Site) operating on the https://www.realtescil.com internet address (and sub-sites) belonging to Real Registry and the services to be purchased through this site with the following terms and conditions.
1.2: The parties declare, accept and undertake the accuracy of the information written in this contract.
2.1: This contract will regulate the sections that the customer is allowed to do and not to do in accordance with the information provided by the customer in his transactions, orders, messages he sends in the registration process, and the fees to be paid to Real Tescil in return for the services he will receive in accordance with his preferences in his orders. These service and transaction descriptions are as follows.
2.2: Membership information is the information entered by the customer during membership. Since this information will be used as a basis for the transactions made, it is assumed that the customer and the member enter this information completely and accurately.
3.1: Real Registry will provide the services specified in the order at the request of the customer. With the message of acceptance of the order, Real Registry will accept that it has collected the relevant fee and will undertake to provide the service specified in the order in question.
3.2: The payment method, VAT differences will be specified with the total amount to be deducted during the order, and the fees that the customer must pay according to the monthly or annual payment preferences will be notified by Real Registry.
3.3: After the order is accepted and the transactions are approved, Real Registry will send the control panel, ftp, sql and e-mail usernames and passwords related to the service in the customer order detail to the customer and the service will have started. The responsibility of the relevant accounts and passwords is the responsibility of the customer and the customer will be responsible for any loss and damage that may arise from these issues.
3.4: The customer undertakes to comply with the statements and warnings received by Real Registry within the service received. The customer declares, accepts and undertakes to comply with any warnings or notices published by Real Registry while benefiting from the hosting account. The customer cannot distribute or sell the services provided to him free of charge and unlimitedly in the hosting service he has received to third parties, either paid or free of charge and / or limited or unlimited.
3.5: The customer undertakes not to access files or programs that he/she does not have the right to access by using the software and programs he/she has within the service, not to create any problems due to such a problem, and to cover the damages in case of problems and problems that may occur.
3.6: The customer accepts and undertakes that the taxes, fees and similar obligations that are in force during the use of the domain name, hosting or services received or that will enter into force during the contract belong to him and that he will meet them.
3.7: The customer accepts and undertakes that he/she is responsible for all files, documents and programs hosted within the service, all transactions that he/she will use and benefit from with the website and e-mail services, and that he/she accepts and undertakes to bear all legal and criminal liability that may arise from the illegality of such data, information and statements. No fault can be attributed to Real Registry for any problems that may arise in this regard.
3.8: Real Tescil does not review, verify, endorse or endorse the pages before they are submitted, nor does it take any responsibility in any way for the pages made by the user. Real Registry may terminate user accounts for violations of these guidelines or for any other reason or because Real Registry believes it is detrimental to its business or the business of any of its users. Real Tescil has the right to delete any unlawful acts and actions without notifying the customer as soon as it learns about them.
3.9: Real Registry cannot be held responsible for any material or moral damages that may arise from the misuse of customer data within the service it provides, data content, all data used by e-mail. Backup and storage obligations of this data belong to the customer. Real Registry will subject all data of the customer to regular backup and maintenance. Despite this, Real Registry is not responsible for any errors, damages and losses that may occur due to interruptions in Real Registry services or loss of data. Backing up the data is the responsibility of the customer unless otherwise stated in the contract text.
3.10: Real Registry will carry out the domain name registration transactions that have been ordered and paid by the customer without any problems. The customer is the owner of the domain name registered and accepted with the order and paid for with the registration request. Real Registry will be able to take action on the domain name in line with the customer's requests in this regard. The Real Registry will make any arrangement, change and transfer requests by the customer on the domain name as soon as possible.
4.1: The rights and obligations of the parties specified in this contract start with the transmission of the order and payment transactions to Real Tescil via the internet.
4.2: The duration of the contract is the payment period selected by the customer during the order for the relevant service.
4.3: If the parties have not notified that the contract will expire at the end of the contract period until 10 business days before the expiration of the contract, the contract will be extended with the same terms and provisions as the previous contract period. (changes in the fee are reserved.)
5.1: The fee to be paid for the services specified in this contract is the amount specified during the order process. It is calculated by including VAT afterwards in the specified fees and collection is realized by showing it to the customer.
5.2: Real Registry reserves the right to change prices and tariffs prospectively without prior notice. The customer accepts, declares and undertakes any changes that may occur in advance regarding these changes.
5.3: If the fee is in foreign currency, it shall be paid by converting it into Turkish Lira at the effective selling rate of the Central Bank on the invoice date.
5.4: In case of delay in payment, Real Registry reserves the right to invoice the exchange rate difference.
5.5: Real Registry reserves the right to close or open the relevant service until the customer completes the payment process.
5.6 : As stated during the order, there is no refund for domain/domain name, SSL certificates and server services (co-location, dedicated, vps virtual servers).
6.1: Real Registry reserves the right to stop all of the services provided to the customer, e-mail, web, ftp accounts due to problems with payment, provision problems for customers with credit card payment orders or articles related to terms and obligations.
6.2: During the continuation of this situation, e-mail, web, ftp access cannot be made on behalf of the customer and e-mail accounts are blocked and incoming e-mails are rejected.
6.3: The maximum CPU and RAM usage rate per site on the server is 10%. User accounts exceeding 10% are suspended after the first warning.
6.4: It is forbidden to have content on our servers that violates both copyrights and Turkish law. This includes hack, crack, warez, adult and mp3 content.
6.5: The security of all software on the server belongs to our customers. Our company is in no way responsible for any issues that may arise from Chmod 777 or any issues that may arise with your software.
6.6: At Real Registry, service invoices are automatically generated 10 days before the due date and an e-mail is sent to the customer for notification purposes. If the payment is not received, a reminder e-mail is sent 3 days before the due date. Warning e-mails are sent on the 1st, 2nd and 3rd day after the due date. If payment is not received, the service is stopped on the 4th day and the customer is notified. All these processes are done automatically. Real Registry may grant an additional 3 days for suspended accounts upon request. No additional time will be granted beyond this period. The suspended account will be deleted from Real Registry's servers after 60 days.
7.1: If the customer does not fulfill its responsibilities and commitments by acting contrary to any article of this contract or if it is determined that the information declared on the face of this contract is not correct, if the above-mentioned contract suspension continues for more than 7 days, Real Tescil has the right to terminate the contract unilaterally without any notice and notice.
7.2: After the termination to be realized in this way, the customer; declares, accepts and undertakes that he / she cannot claim back the last contract fee he / she has paid regardless of the remaining period, and declares, accepts and undertakes to pay 5 times the commercial penal compensation of the equivalent contract price in force on the date of termination.
7.3: The customer has the right to terminate this contract at the end of its term, without any justification, provided that it is notified in writing 10 days before the contract expires with the normal term.
7.4: In the event that the contract is terminated by the customer before the expiration of the contract, it declares, accepts and undertakes to pay 1/2 of the fees to be paid until the end of the contract in advance and in advance.
8- Contact and Information Addresses
8.1: The parties have accepted, declared and undertaken to accept, declare and undertake the postal addresses specified in the order address as the legal residence for all kinds of notifications arising from the contract.
8.2: All notifications made to these addresses shall be deemed to have been notified even if they are not received by the parties. Unless the changes of these addresses are notified to the other party in writing, the old addresses will be valid.
8.3: Real Registry may send messages, information, letters, warnings, payment notices, account activity charts, account statements to the e-mail address allocated to the customer during the contract period. The customer cannot claim that such electronic messages have not been received or that they have not been received, and declares, accepts and undertakes that such messages will be deemed to have been legally notified 1 day after the date they are sent.
9- Default in Payment of Wages
9.1: If the Customer fails to make payment for the services received within 7 days following the application date, the Customer shall be deemed to be in default. In this case, Real Registry may issue a currency difference invoice or, if it wishes, may demand 15% monthly default interest from the invoice date. The Customer declares and agrees to pay this delay interest and exchange rate difference invoice.
9.2: The Customer declares, accepts and undertakes to pay 15% monthly default interest, penal clause up to 50% of the balance debt amount, 10% Attorney's Fees and all other legal expenses in case Real Registry opens a lawsuit or enforcement proceedings for any receivables arising from this contract.
9.3: The Customer hereby declares, accepts and undertakes that in case the legal authorities apply for Precautionary Attachment and Precautionary Measure for the collection of receivables arising from this contract, Real Tescil is authorized to take Precautionary Attachment and Precautionary Measure decision without collateral, but despite this, when collateral is requested by the Courts, the commission and all kinds of fees arising from the letters of guarantee to be received from the Banks will be paid by them and they will not make any objection to these issues.
10- Authorized Courts and Enforcement Offices
10.1: This agreement consists of 10 articles, sub-headings and Annex-1 and has been read, understood and signed by the parties. (Signing is deemed to have taken place when the order is sent to Real Tescil on the internet). Real Registry may add or remove new articles and/or subheadings or make changes on the articles if it deems necessary. The customer declares and undertakes that he/she accepts these changes in advance.
10.2: Istanbul Courts and Enforcement Offices are authorized to resolve any disputes arising during the implementation of this agreement.
Account Settings / Email address
Your account will be activated after payment has been received. It is entirely at your discretion whether the e-mail address in your account is valid or not. If there are any complaints or if we need to contact you, we will contact you using your primary e-mail address in your customer panel. For this reason, it is in your best interest to enter your e-mail address correctly and check it regularly. Entering incorrect contact information may result in bad consequences such as closing your account.
Our transfer team will make maximum effort during your transfer process to Real Registry. The transfer process is a free service offered for the convenience of users only. Real Tescil cannot guarantee that the migration is possible and will be completed in any given time. Each hosting company is organized differently and some hosting platforms store data incompatible or personalized. This can make the move inconvenient or extremely difficult. We will do the best we can, but we would like to point out that in some cases we will not be able to help you with your move. Currently, we only offer cPanel to cPanel migration services. The number of sites that can be migrated for free is 10. If the number of sites to be moved is more than 10, you can have it moved to our team by paying 2TL including VAT per site depending on your request.
Free migration service only covers a period of 30 days from the start date of your membership.
All services provided by Real Tescil must be used for legal purposes. Real Tescil accepts the laws of the Republic of Turkey. No written, audio or visual content, material presented on Real Registry servers cannot be contrary to the laws of the Republic of Turkey. Otherwise, all material and moral responsibilities arising / to arise belong to the customer. Service provider Real Tescil is not liable.
Customers guarantee that they will not put Real Tescil in a situation that will be damaged due to the services it provides.
Infringement of trademarks or copyrights is prohibited on our services. This includes any unauthorized copying of music, books, photographs or any other copyrighted material. Selling counterfeit versions of any trademarked services will result in immediate deletion of your account. Any account found violating these rules, violating copyrights, will be frozen or deleted completely. If you believe that your copyrights or trademark rights have been violated, you can send an e-mail to firstname.lastname@example.org with the necessary information. If a license is involved, we may require the necessary documentation.
It is forbidden to use shared hosting as a backup or storage, "Only 1 cPanel backup in compressed (.tar.gz, .rar, .zip, etc.) format can be found on FTP. Please do not back up your backups.
Below you can find examples of prohibited material on the Shared or Reseller service:
Real Tescil services, all related equipment, network and network devices are authorized for customer use only. Real Registry may occasionally monitor the services it provides for legal issues, to check whether the customer is making authorized use, for system administration, to prevent unauthorized use, to check security procedures and for operational security. During this monitoring process, information may be reviewed, recorded or copied. By using Real Tescil services, you agree to this monitoring process.
Real Registry reserves the right to refuse the service used. Intervention in the use of the service offered is under the sole control of Real Registry. For example, sites that contain threatening or copyright infringing content may be deleted from our servers without warning. In these and similar cases, our Complaints department will contact you (by phone or e-mail) and if no result is obtained within 48 hours, your account may be frozen or deleted.

For Reseller/Reseller users: Accounts will be frozen when similar circumstances occur and a message will be sent to the reseller owner to delete the account. In case of multiple similar violations, Real Registry may freeze or cancel your reseller account.
For direct customers: Your account will be deleted from our servers without sending any message.
When the above-mentioned situation occurs, Real Tescil reports the necessary information to the competent authorities.
It is the sole responsibility of the customer to ensure that the scripts / programs you use in your account are secure and that file permissions are set correctly. Users are responsible for all changes that occur in their accounts. This includes the username and password you use when logging into the system. For your security, you should make sure that your password is difficult. If you use a weak password (such as 123456), your account may be frozen until you agree to use a strong password. If your password is found to be weak during the account check process, we will send you a message to change/update your password.
Zero tolerance for spam!
We do not show any tolerance for unsolicited emails. The accounts of spamming users will be deleted without any warning message.
Customers using shared hosting services can review the Mail Policy.
Spammers cannot be hosted on Real Registry servers. This prohibition does not cover only fax, instant messaging or Usenet/Newsgroup categories.
Real Tescil reserves the right to make changes to any web page, account, database or other components as it deems necessary.
You are obliged to pay for any service you receive from Real Registry. Real Registry guarantees the continuity of the service until the end of the provision of the service for which payment has been made. You are obliged to make payment unless you notify us to cancel the use of the service you have ordered or as long as you use the entire service we provide to you.

As a Real Tescil customer, it is your sole responsibility to enter your customer information correctly and to make your payments on time. Real Registry guarantees that it will keep your data for 10 days from the invoice date. If you do not pay your invoice for 10 days, your account may be frozen or deleted. If there will be a delay in your payments, we ask that you contact us to let us know so that your account will not be frozen or deleted.

Real Registry reserves the right to change the payment amount and service fee at any time.
Backup and Data Loss
Backup is the sole responsibility of the customer. Our backup service is only a free security service that we provide. Real Registry is not responsible for any data/file loss you may experience. With this agreement, you agree that you have all rights to your files.
Cancellations and Refunds
Real Registry reserves the right to close and freeze user accounts at any time without any warning.
Customers can request account cancellation at any time. For detailed information about account cancellation, you can send an e-mail to firstname.lastname@example.org or contact us via 0850 850 34 58. Real Registry can refund you within 7 days in case of any dissatisfaction.
Users may not do the following:
Resource Utilization - INODEs
Any shared hosting service (including reseller hosting) user using more than 100000 inodes will receive a warning. If a warning is issued and no action is taken, the account will be frozen. Users exceeding the 20000 inode limit will have their accounts automatically deleted from our backup system to stabilize average usage. Each file (web page, image, e-mail, etc.) uses 1 inode.
We do not like to freeze the accounts of users who do not exceed the usage limit too much; however, we do review and/or freeze the accounts of users who frequently create and delete large files, create hundreds of thousands of files, or cause system damage.
Daily and weekly backups are not taken by us for users who use more than 2 GB of disk space in shared hosting service. In order to prevent loss of all data in case of any hardware problem, Real Registry takes daily, weekly and monthly backups. These backups are not for the use of users, but to prevent loss of data in case of any technical problem.
You can use the traffic space allocated to you. The quota for this is as stipulated by the hosting package you have purchased. If you exceed the quota we have allocated to you, you can freeze your account until your next quota is created, you can buy additional traffic, you can switch to a hosting package with higher features. Unused traffic during the month cannot be transferred to the next month. For our customers using hosting with unlimited traffic; As long as they do not exceed their resource usage and comply with the terms in the contract of the package they receive, their accounts will not be frozen or deleted due to traffic. In web hosting packages with unlimited traffic, bandwidth is unlimited only for your site for which you have purchased service. You cannot make traffic available to other sites.
There is no money back guarantee on the server service. The 7-day money back guarantee does not cover this issue. All reseller and shared hosting service packages provided by Real Tescil are covered by a 7-day money back guarantee. Please note that this 7-day money back guarantee is only for users who use shared or reseller packages and make monthly payments. It does not cover additional costs such as server rental, domain name registration, administrative costs, package add-ons.
Our shared hosting and Reseller servers are monitored 24 hours a day, in the event of an outage on any of our servers, we guarantee to intervene as soon as possible. However, this period may extend in direct proportion to the workload of the datacenter where our servers are located and the problem that may occur on the server. We guarantee 98% uptime to our customers who use shared hosting and Reseller service. If this uptime period falls below a certain number, we extend the service period at a rate 2 times the downtime for the satisfaction of our customers.
Reseller Customer Responsibility
Shared Hosting / VPS
Users using shared hosting cannot offer hosting services. If you want to offer hosting, you must have a reseller account. Backups of VPS accounts are not taken, you must back up to an external domain yourself.
It is the sole responsibility of the customer to have a valid e-mail account and to secure the root password. Real Registry does not perform any backups for the servers, it is the sole responsibility of the customer to manage and create backups. If you want, you can buy an additional hard disk for the backup system and manage your backups, this is the simplest solution we can offer you. If you need a second hard disk, you can contact us via e-mail email@example.com. Managing your backups is entirely your responsibility.
